Welcome to Tripzy! These Terms of Service ("Terms") govern your access to and use of the Tripzy mobile application and related services (collectively, the "Service") provided by Invsion OG ("we," "our," or "us").

By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Service.

2. Description of Service

Tripzy is an AI-powered travel planning application that helps users create personalized trip itineraries. Our Service includes:

• AI-generated travel itineraries
• Day-by-day trip planning with recommendations for restaurants, attractions, and activities
• Interactive maps and location information
• Packing lists and travel document organization (Premium)
• Offline access to trips (Premium)
• Collaborative trip planning with friends and family (Premium)

3. User Accounts

3.1 Account Creation

To use certain features of the Service, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and update your information to keep it accurate
• Keep your account credentials secure and confidential
• Notify us immediately of any unauthorized access to your account

3.2 Account Responsibility

You are responsible for all activities that occur under your account. We are not liable for any loss or damage arising from unauthorized use of your account.

3.3 Age Requirement

You must be at least 13 years old to use our Service. If you are under 18, you may only use the Service with the consent and supervision of a parent or legal guardian.

4. Premium Subscription

4.1 Subscription Plans

Tripzy offers premium features through subscription plans. Premium features include offline access, document storage, collaborative planning, and advanced packing lists.

4.2 Payment and Billing

Subscriptions are processed through Apple App Store or Google Play Store. Payment terms, billing cycles, and prices are subject to the respective platform's policies.

4.3 Cancellation and Refunds

You may cancel your subscription at any time through your Apple or Google account settings. Cancellations and refunds are governed by Apple's and Google's respective policies. We do not process refunds directly.

4.4 Free Trial

We may offer free trial periods for Premium subscriptions. If you do not cancel before the trial ends, you will be automatically charged for the subscription unless otherwise specified.

5. Acceptable Use

5.1 Permitted Use

You may use the Service only for lawful purposes and in accordance with these Terms.

5.2 Prohibited Activities

You agree NOT to:

• Use the Service for any illegal or unauthorized purpose
• Attempt to gain unauthorized access to our systems or other users' accounts
• Interfere with or disrupt the Service or servers
• Use automated systems (bots, scrapers) to access the Service
• Reverse engineer, decompile, or disassemble any part of the Service
• Remove or modify any copyright, trademark, or proprietary notices
• Upload malicious code, viruses, or harmful content
• Harass, abuse, or harm other users
• Impersonate any person or entity
• Use the Service to spam or send unsolicited messages

6. Intellectual Property Rights

6.1 Our Content

The Service, including all content, features, functionality, and AI-generated recommendations, is owned by Invsion OG and is protected by international copyright, trademark, and other intellectual property laws.

6.2 Your Content

You retain ownership of any content you create or upload to the Service (e.g., custom trip notes, photos). By using the Service, you grant us a limited license to use, store, and display your content solely to provide the Service to you.

6.3 AI-Generated Itineraries

Itineraries and recommendations generated by our AI remain the property of Invsion OG. However, you have a personal, non-transferable right to use them for your own travel planning purposes.

7. Third-Party Services and Links

Our Service may contain links to third-party websites, services, or content that are not owned or controlled by us. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party services.

Third-party services include but are not limited to:

• Google Maps for map and location services
• Weather and flight information APIs
• OpenAI and Claude AI services
• RevenueCat for payment processing

8. Disclaimers and Limitations of Liability

8.1 "As Is" Service

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

8.2 No Travel Guarantees

Tripzy is a planning tool only. We do not:

• Make or confirm travel bookings (flights, hotels, activities)
• Guarantee the accuracy of AI-generated recommendations
• Guarantee that destinations, restaurants, or attractions will be available or open
• Provide travel insurance or assume liability for travel-related incidents
• Guarantee real-time accuracy of weather or flight information

8.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, INVSION OG SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

9. Indemnification

You agree to indemnify, defend, and hold harmless Invsion OG and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of another party
• Your conduct in connection with the Service

10. Termination

10.1 Termination by You

You may terminate your account at any time by deleting it through the app settings or by contacting us at office@invsion.at. Upon termination, your personal data will be deleted as described in our Privacy Policy.

10.2 Termination by Us

We may terminate or suspend your account immediately, without prior notice, if you breach these Terms or engage in conduct that we deem inappropriate or harmful to the Service or other users.

11. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Austria, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts in Groß-Enzersdorf, Austria.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.

13. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
